Eulogize This is an entertainment-only AI-powered eulogy generator. Our service generates dramatic, witty, and humorous eulogies for any subject (objects, concepts, people, situations, etc.). This service is provided for entertainment purposes only and should not be relied upon as actual memorial content, professional writing services, or advice of any kind.

2. Acceptable Use Policy

You agree not to use our service to:

• Generate content targeting real people in harmful, harassing, or defamatory ways
• Create hate speech, discriminatory, or abusive content
• Generate content that threatens, intimidates, or encourages violence
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Spam, manipulate, or attempt to gain unauthorized access
• Create content that endangers child safety
• Impersonate others or misrepresent your identity

3. Content Ownership & License

All eulogies generated by Eulogize This are provided under the Creative Commons Attribution 4.0 International License (CC-BY-4.0). This means:

• You are free to share and adapt the content
• You must give appropriate credit to Eulogize This
• You must include a link to the CC-BY-4.0 license
• You may use the content for commercial purposes with proper attribution

We retain the right to use all generated eulogies for service improvement, analytics, and marketing purposes (with personal data removed where applicable).

4. Disclaimer of Warranties

Eulogize This is provided "as is" without any warranties, express or implied. We do not warrant:

• That the service will be uninterrupted, secure, or error-free
• That content will meet your expectations or requirements
• That any defects will be corrected
• That the service is suitable for any particular purpose

Use of Eulogize This is at your sole risk. We are not liable for any damages resulting from service use, including loss of data, revenue, or business opportunities.

5. Refund Policy

We offer a 7-day refund policy for technical issues only. Refunds are available if:

• The service fails to function properly for your account
• You experience persistent technical errors preventing use
• Refund is requested within 7 days of purchase

Refunds are NOT available for: changes of mind, dissatisfaction with generated content quality, or feature unavailability. To request a refund, contact support@eulogizethis.com with evidence of the technical issue.

6. Age Requirement

You must be at least 13 years old to use Eulogize This. By using our service, you represent that you are at least 13 years old. We do not knowingly collect information from children under 13. If we become aware of such collection, we will delete the data and terminate the account.

7. Account Termination

We may terminate or suspend your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Generate prohibited content
• Pose a safety risk to other users

Upon termination, you lose access to your account and any generated content. No refund will be provided for remaining subscription time due to violation of these terms.

8. Limitation of Liability

To the maximum extent permitted by law, Eulogize This and its creators are not liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Unauthorized access to or alteration of your data
• Any damages arising from your use of the service

Our total liability to you shall not exceed the amount you paid for the service in the preceding 12 months (or $0 for free tier users).

9. Indemnification

You agree to indemnify, defend, and hold harmless Eulogize This, its owners, and operators from any claims, damages, losses, or costs (including legal fees) arising from: your use of the service, content you generate, violation of these terms, or violation of any applicable laws.

10. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these terms shall be exclusively resolved through binding arbitration administered by JAMS, rather than in court. This arbitration agreement applies to all claims, whether they are contract-based, tort-based, or statutory in nature.

11. Modifications to Terms

We may modify these Terms of Service at any time. Changes become effective when posted to our website. Continued use of Eulogize This after changes constitutes acceptance of the modified terms. We will notify users of material changes via email or prominent notice.

12. Severability

If any provision of these terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if that's impossible, severed. The remainder of these terms remain in full effect.
